These Terms of Service (“Terms”) govern your access to and use of the SpeakShare mobile app and website (the “Service”), provided by SpeakShare(“SpeakShare”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using the Service, you represent that you meet this requirement and are able to enter into a binding agreement.
The Service
SpeakShare lets you practice speaking on camera through guided practice modes, receive automated transcripts and AI-generated coaching feedback, and share recordings with a community. Some features have usage limits, such as a maximum recording length and daily limits on AI captions and feedback analyses. We may adjust these limits, and add, change, or remove features, as the Service evolves.
Your account
You are responsible for the activity that occurs under your account and for keeping your login credentials secure. You agree to provide accurate information and to notify us of any unauthorized use of your account. You can delete your account at any time in the app under Profile, Account Management; deletion becomes permanent after a 30-day grace period, as described in our Privacy Policy.
Your content
You retain ownership of the recordings and other content you create (“User Content”). By submitting User Content, you grant SpeakShare a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display that content as needed to operate the Service, including processing your recordings through our service providers to generate transcripts, captions, delivery metrics, and coaching feedback. We do not use your User Content to train AI models, and we do not permit our providers to do so.
When you publish content publicly or to followers, you also grant other users the ability to view and interact with it according to your chosen settings. If you choose to cross-post a recording to TikTok, you authorize us to transmit that recording to TikTok on your behalf; what happens on TikTok is governed by TikTok’s own terms.
AI features
The Service provides automated transcripts and AI-generated speaking feedback. This feedback is produced by automated systems, is provided for practice and informational purposes only, may contain errors, and is not professional, medical, or career advice. Use your own judgment when acting on it.
Community standards and acceptable use
SpeakShare is a supportive practice community, and we have no tolerance for objectionable content or abusive behavior. You agree not to use the Service to:
- Post content that is unlawful, harassing, hateful, threatening, defamatory, sexually explicit, or that infringes the rights of others.
- Upload content you do not have the right to share, or that violates any intellectual property or privacy rights.
- Bully, harass, or intimidate other users.
- Impersonate others or misrepresent your affiliation.
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
- Collect data about other users without their consent.
- Use the Service to spam, advertise without authorization, or distribute malware.
Moderation, reporting, and termination
The app gives you tools to report videos, comments, and users, and to block users so they cannot see your content or interact with you. We review reports and may remove content, restrict features, or suspend or terminate accounts that violate these Terms, without notice where necessary, including immediately removing objectionable content and ejecting the users who post it. You may stop using the Service and delete your account at any time.
Purchases, credits, and subscriptions
Parts of the Service are free to use, with daily limits on AI features. You can buy feedback credits, and where offered, a subscription, to unlock additional use. All purchases are billed by Apple’s App Store or Google Play under their payment terms; we verify purchases on our servers before crediting your account.
- Credits: feedback credits are consumed when you use AI features. Credits are not money, have no cash value, cannot be transferred, and expire when your account is deleted.
- Subscriptions: where offered, subscriptions renew automatically until cancelled. You can cancel anytime in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period.
- Refunds: purchases are refundable only as provided by the App Store or Google Play refund policies, or as required by law. Refund requests are handled by the platform you purchased through.
- Changes: we may change prices, credit amounts, free allowances, and what features require credits, with effect for future purchases.
Copyright complaints
If you believe content on the Service infringes your copyright, send a notice to hello@speakshare.io identifying the work, the infringing content, and your contact details. We will review and, where appropriate, remove the content and may terminate the accounts of repeat infringers.
Third-party services
The Service integrates with third parties such as sign-in providers (Google, Apple, and X) and TikTok. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
App store terms
You also agree to comply with the applicable app marketplace terms when you download the app. Apple and Google are not parties to these Terms, are not responsible for the Service or its content, and have no obligation to provide support or maintenance for it. If you downloaded the app from Apple’s App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
Our intellectual property
The Service, including its software, design, and branding, is owned by SpeakShare and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other brand features.
Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, SpeakShare will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill arising from your use of the Service.
Indemnification
You agree to indemnify and hold harmless SpeakShare from any claims, damages, or expenses arising out of your User Content or your violation of these Terms.
Governing law
These Terms are governed by the laws of the jurisdiction in which SpeakShare operates, without regard to conflict-of-law principles.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
